Terms and Conditions

The terms that apply when you use this website.

Acceptance of these terms

This website is operated by Cognifence, Inc. (“Cognifence,” “we,” “us”). By accessing or using the site you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the site. If you use the site on behalf of an organization, you accept these Terms for that organization.

Informational purpose

This is an informational website for Cognifence while the company is in development. Its content is provided for general information only. Nothing on the site is an offer, solicitation or binding commitment, and it does not constitute professional, legal, financial, security or other advice. These Terms cover your use of this website only. They do not cover the Cognifence platform or any pilot, evaluation or other service, which are governed by separate written agreements.

Intellectual property

All content on this site, including text, research notes, data, figures, graphics, logos and the Cognifence name and marks, is owned by Cognifence or its licensors and is protected by applicable law. All rights reserved. You may view the site, share links to it, and quote short excerpts with attribution. Any other use, including copying, reproduction, republication, framing, scraping, text or data mining, or commercial use, requires our prior written permission.

Acceptable use

You agree not to use the site in any unlawful way, and not to: attempt to gain unauthorized access to, probe, scan or test the vulnerability of the site or any related system; interfere with or disrupt the site or its security; use any bot, scraper or other automated means to access or collect content, except for compliant search-engine indexing; reverse engineer any part of the site; or misrepresent your identity or affiliation. We may suspend or restrict access at any time, without notice, to protect the site.

Research and forward-looking statements

Research results, benchmarks, figures and examples describe specific evaluations carried out at a specific time. They may change, may not generalize, and are not a guarantee or representation about any product, model, service or outcome. Statements about our plans, capabilities or future products are forward-looking and are not commitments. Names of third-party models, products and companies are trademarks of their respective owners and are used only to identify them; our evaluations are not endorsements of, and do not imply any affiliation with, those owners.

No warranty

The site and all of its content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, title and non-infringement. We do not warrant that the site will be uninterrupted, timely, secure or error-free, or that any content is accurate or complete.

Limitation of liability

To the fullest extent permitted by law, Cognifence and its officers, employees, advisers and agents will not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for any loss of data, profits, revenue, business or goodwill, arising out of or relating to your access to or use of (or inability to use) the site, even if we have been advised of the possibility. To the fullest extent permitted by law, our total aggregate liability for any claim relating to the site will not exceed one hundred US dollars (US$100). Some jurisdictions do not allow certain of these limitations, so some may not apply to you.

Indemnity

You agree to indemnify and hold Cognifence harmless from any claim, loss or expense (including reasonable legal fees) arising out of your misuse of the site or your breach of these Terms.

Third-party links

The site may link to third-party websites or resources. These are provided for convenience only; we do not control them and are not responsible for their content, policies or practices.

Changes

We may change the site and these Terms at any time. Changes take effect when posted, and your continued use of the site means you accept them. The date below shows the current version.

Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located there. If any provision of these Terms is found unenforceable, the remaining provisions will stay in effect, and these Terms are the entire agreement between you and Cognifence, Inc. regarding your use of the site.
